About Our Firm

Full-Service Counsel in New York Probate

At my law firm, Barry Seidel & Associates, Attorneys at Law, my goal is to help people when they need to understand the probate and estate administration process under New York law. Whether or not there is a Will, a new legal entity comes into existence whenever a person dies — the decedent's estate. Probate law is meant to guide people through the process of putting the decedent's property and surviving commitments into proper hands, both to transfer assets between generations and to take care of unfinished business.

I opened my own firm right out of law school in 1982, and I have been in my own practice since that time. My first office was in Manhattan, where I practiced for two years. Then I moved my office to Forest Hills, where I grew up, and I have stayed here ever since. My office is at the corner of 69th avenue and Metropolitan avenue in Forest Hills, easily accessible by car, bus or subway. There is ample street parking in this part of Forest Hills.

If there is no will, contact my office to learn how you can benefit from my experience. I can help if you have been named as the executor under the terms of a will, or if you want to be appointed as an administrator to handle an estate.

Some estates are simple to handle, while others can be very complex. Even small estates sometimes have complicated problems that need a lawyer's attention. In many situations, the executor or administrator must get to work right away on legal issues that their position entails. Examples include real estate sales, business operations, contract performance, will contests or even wrongful death claims. Estate administration begins with getting someone appointed as an executor or administrator, but each individual case takes its own course.

My law firm also helps people resolve two kinds of problems that can come up right after a death in the family — how to pay for a funeral, and how to resolve conflicts about funeral arrangements and burial. These issues require practical knowledge, a tactful approach and an in-depth understanding of relevant laws and policies.

I can help you through each stage of the process. I have several main objectives when working with executors and administrators: move the matter along expeditiously, avoid mistakes and disputes that could delay the process, avoid errors that could expose you to liability, and protect the value of the estate's assets through smart decisions and correct timing.
